5. US State Privacy Rights (e.g., CCPA/CPRA, VCDPA)

This section provides specific disclosures and rights for residents of certain US states with comprehensive privacy laws, including California, Virginia, Colorado, Connecticut, and Utah.

A. Definitions of “Selling” and “Sharing”

  • No Traditional “Selling”: Caperion does not sell your personal information to third parties in exchange for money.

  • Disclosure of “Selling” or “Sharing”: Under California law (CCPA/CPRA), and similar laws in other states, the use of certain third-party cookies for targeted advertising or cross-context behavioral advertising may be classified as “sharing” or “selling” personal information (even if no money changes hands).

    • Categories of Information “Shared” or “Sold” via Cookies: Online identifiers (IP address), cookie identifiers, internet or other electronic network activity information.

    • Categories of Third Parties with whom this information is “Shared” or “Sold”: Analytics providers (Google Analytics, Microsoft Clarity) and advertising networks (Google Ads, Meta).

B. Your Rights

If you are a resident of one of these states, you may have the following rights, subject to certain exceptions:

  • Right to Know/Access: You have the right to request that we disclose what personal information we collect, use, disclose, and “sell” or “share” about you.

  • Right to Delete: You have the right to request the deletion of your personal information that we have collected, subject to certain exceptions (e.g., complete a transaction, detect security incidents).

  • Right to Correct: You have the right to request that we correct inaccurate personal information that we maintain about you.

  • Right to Opt-Out of “Sale” or “Sharing”: You have the right to direct us not to “sell” or “share” your personal information (including targeted advertising based on cookies).

C. How to Exercise Your Rights

  • Opt-Out Mechanism (Crucial): To exercise your right to opt-out of the “selling” or “sharing” of your personal information, please click on the link visible in our footer that says “Do Not Sell or Share My Personal Information”.

  • Submit a Request: To exercise your other rights (Know, Delete, Correct), please submit a verifiable request by:

    • Emailing us at support@caperion.net.

    • Calling us toll-free at +1 (561) 627-0007.

  • Universal Opt-Out Preference Signals (GPC): Caperion recognizes and processes universal opt-out preference signals, such as the Global Privacy Control (GPC), which are sent in a format commonly used and recognized by browsers. If your browser sends a GPC signal, we will treat it as a valid request to opt-out of the “selling” or “sharing” of personal information for that browser and device.

Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.

D. Non-Discrimination

We will not discriminate against you for exercising any of your CCPA/CPRA or other state privacy rights.

6. Do Not Track Signals

Some web browsers may transmit “Do Not Track” (“DNT”) signals to websites. Because there is not yet a common industry standard for DNT signals, Caperion.net does not currently respond to DNT signals, but we do respond to Global Privacy Control (GPC) signals as an Opt-Out.

7. Children Under the Age of 13

Our Site is not intended for children under 13 years of age. We do not knowingly collect personal information from children under 13. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information.

8. Data Security

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Site.

9. International Data Transfers

Our Site and services are hosted in the United States. If you access the Site from outside the United States, please be aware that your information may be transferred to, stored, and processed in the United States. The data protection and other laws of the United States and other countries might not be as comprehensive as those in your country.

10. Changes to Our Privacy Policy

It is our policy to post any changes we make to our Privacy Policy on this page. If we make material changes to how we treat our users’ personal information, we will notify you through a notice on the Site home page.
